In a letter sent to NH school districts on April 3, the Trump administration threatened loss of federal funding to any school district that fails to certify that they comply with Title VI of the Civil Rights Act of 1964, which prohibits discrimination on the basis of race, color, or national origin. Districts must also attest that they follow the Supreme Court’s ruling in SFFA v. Harvard, which struck down the use of race-based affirmative action in higher education admissions. The certification requirement is part of the administration’s efforts to root out diversity, equity, and inclusion programming in K-12 public schools.
Nottingham’s school district has complied.
The National Education Association - the state’s largest teacher union, with 17,000 NH members, has asked federal Judge Landya McCafferty to block the certification process, arguing that it “chills basic educator practices” and infringes upon union members’ constitutional rights.
